1. Introduction

These Terms & Conditions (“Terms”) govern your use of Sumly, an AI-powered maths practice platform operated by Sumly (“we”, “us”, or “our”). By registering for or using Sumly, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

These Terms should be read alongside our Privacy Policy, which explains how we collect and process personal data. Together, these documents form the agreement between you and Sumly.

2. Definitions

In these Terms, the following words have the meanings set out below:

• “Service” — the Sumly platform and website, accessible at sumly.app, including all features, content, and functionality made available to users.
• “User” — any individual who accesses or uses the Service, including parents, teachers, and students.
• “Parent/Teacher Account” — an account held by an adult (parent or teacher) who is responsible for creating and managing one or more Student Accounts.
• “Student Account” — an account created by the holder of a Parent/Teacher Account on behalf of a child or student. Students cannot register independently.
• “Content” — all questions, answers, explanations, feedback, reports, and other material generated or displayed through the Service.

3. Account Registration

To use the Service, you must register for a Parent/Teacher Account. By registering you confirm that:

• you are at least 18 years of age;
• the information you provide during registration is accurate, current, and complete;
• you will keep your account credentials confidential and not share them with others;
• you accept full responsibility for all activity that occurs under your account and any Student Accounts linked to it.

Student Accounts may only be created by the holder of a Parent/Teacher Account. Children and students cannot register directly. The adult account holder is responsible for ensuring that any child using the Service does so in accordance with these Terms.

We reserve the right to suspend or terminate any account where we have reason to believe that registration information is false, misleading, or that these Terms have been breached.

4. Use of the Service

Sumly is provided for personal, non-commercial educational use only. The Service is intended to support maths practice aligned with the UK National Curriculum for students in Years 5 to 11.

The Service is not a substitute for formal education or accredited assessment. Questions and practice materials generated by Sumly are intended as supplementary learning aids and should not be relied upon as formal assessment, curriculum delivery, or examination preparation in isolation.

You agree to use the Service only in accordance with these Terms, applicable law, and any guidance we publish from time to time.

5. AI-Generated Content

Questions, explanations, and feedback on Sumly are generated by artificial intelligence models powered by AWS Bedrock. We design our prompts and systems to align with the UK National Curriculum; however:

• AI-generated content may occasionally contain errors, inaccuracies, or incomplete information;
• we do not guarantee that any question is fully accurate, exhaustive, or perfectly matched to any specific curriculum specification or exam board requirement;
• AI-generated explanations are intended as learning aids only and should not be treated as authoritative mathematical instruction.

We continually work to improve the quality and accuracy of AI-generated content. If you believe a question or answer contains an error, please contact us at support@sumly.app.

6. Children's Accounts

Sumly is designed with children's safety as a priority. All Student Accounts must be created by a Parent/Teacher Account holder. Children cannot create their own accounts or provide personal data to us directly without adult involvement.

Content displayed to students is designed to be age-appropriate and is filtered to remain within the scope of educational maths practice. Students do not have access to messaging, social features, or user-generated content.

The Parent/Teacher Account holder is responsible for:

• ensuring that the child's account details (name, year group) are accurate;
• supervising the child's use of the Service as appropriate;
• ensuring the child uses the Service only for its intended educational purpose.

7. Acceptable Use

You agree that you will not:

• share your account credentials with any other person;
• allow another adult to use your Parent/Teacher Account without transferring account responsibility appropriately;
• use any automated means (bots, scrapers, crawlers, or scripts) to access, extract, or interact with the Service;
• attempt to reverse-engineer, decompile, or otherwise extract the source code or underlying logic of the Service;
• use the Service in any way that could damage, disable, overburden, or impair our infrastructure;
• attempt to gain unauthorised access to any part of the Service or to any account other than your own;
• use the Service for any purpose other than legitimate personal educational use.

Breach of these acceptable use provisions may result in immediate termination of your account and, where appropriate, referral to relevant law enforcement or regulatory authorities.

8. Intellectual Property

All intellectual property rights in the Sumly platform, including its design, software, branding, and AI-generated Content, are owned by or licensed to Sumly. Nothing in these Terms transfers any such rights to you.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service and its Content solely for your own personal educational purposes, or (for teachers) for use with students under your direct supervision.

You may not reproduce, distribute, publish, sell, or otherwise exploit any part of the Service or its Content without our prior written consent. This includes copying questions into third-party platforms, worksheets for commercial sale, or any form of systematic extraction.

9. Data Protection

We take the privacy and security of your personal data, and that of any children using the Service, seriously. We are committed to complying with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Personal data is stored securely on Amazon Web Services infrastructure (including DynamoDB, S3, and Cognito), located within the AWS region(s) that we operate. Full details of the personal data we collect, the lawful bases on which we process it, your rights as a data subject, and how to exercise those rights are set out in our Privacy Policy.

By using the Service and creating Student Accounts for children in your care, you confirm that you have the authority to consent to the processing of their personal data as described in our Privacy Policy.

10. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we exclude all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular, we do not warrant that:

• the Service will be uninterrupted, error-free, or available at all times;
• AI-generated questions, answers, or explanations will be free from errors;
• use of the Service will result in any particular educational outcome, improvement in grades, or success in examinations.

To the fullest extent permitted by law, Sumly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including any reliance on AI-generated content or any examination results.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

11. Termination

You may close your account at any time by contacting us at support@sumly.app. Closing your Parent/Teacher Account will also close all associated Student Accounts.

We may suspend or terminate your account immediately, without prior notice or liability, if we reasonably believe you have breached these Terms or if we are required to do so by law.

Upon termination or account closure, you may request deletion of your personal data and that of any Student Accounts in accordance with our Privacy Policy. We will fulfil such requests in line with our obligations under UK GDPR, subject to any legal retention requirements.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, applicable law, or our business practices. When we make material changes, we will notify you by email (to the address registered on your account) or by displaying a prominent notice within the Service, at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you should stop using the Service and close your account.

13. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.
